Introduction

Please thoroughly read the current User Terms and Services. The terms and services are subject to change at any time. Storypal is continually altering, updating, and polishing the site. There is no guarantee that features and functions will remain on the site permanently. Storypal may make changes to the accessibility of Storypal to users at any time. Storypal is currently has both free and premium services. Not all changes will be announced to the users.  However, any policy changes that impact user privacy will be informed to the users through site messages or email notifications. You have full right to agree or disagree to the user terms. Storypal is unable to provide service without your independent agreement to the User Terms and Services. Please read the following terms carefully.  

General

Storypal is a site that is designed to connect students and guardians from around the world. Students are given a safe space to express themselves, collaborate with others, and gain insight from peers and guardians. Guardians are the adults who mentor and aid students in their interaction with other users. Their involvement is to expand a young user’s critical thinking, communication, creativity, and collaboration skills while building safety and communal trust. They have very specific roles. Their primary role includes communicating with their students and other guardians. Guardians will be contacted by the Storypal team via email or via on-site messages. 

By using the Storypal service, you are agreeing that you will not post, upload, publish any content that: (i) violates a third party’s patent, trademark, or rights of publicity or privacy; (ii) violates or encourages any behavior that would violate, any applicable law or regulation or would give rise to civil liability; (iii) false or deceptive information; (iv) is defamatory, obscene, pornographic, vulgar, or offensive; (v) promotes hatred of any sort, promotes discrimination, bigotry, or harm against any individual or group; (vi) is violent, promotes violence, actions that are threatening to people or entities; or (vii) promotes illegal activities or substances.  

 

Safety

 We do our best to insure that our site is safe; however Storypal is not liable for any abuse that may happen on the site. We have taken the utmost precautions and measures to combat unsafe actions, but please remember to use your own personal  judgement when using the site.

Storypal Copyright, Trademark, and Technology

Storypal has complete ownership of all its mascots, logos, and website. Storypal is a company based and incorporated in Korea. Storypal reserves the right to take legal action against those who do not follow copyright and trademark laws. Storypal is for educational use. It may never be used for commercial use by any of its users unless otherwise formally agreed upon with Storypal as a legal body in advance.

Logo and Mascot Usage

Users of the site are allowed to use the Storypal logo and mascots or create secondary creative contents of the logo and mascots on the Storypal site or other places only for noncommercial educational purposes of individuals. The logo and mascots are not for personal or commercial use except for the right explicitly granted by Storypal as stated above. Storypal will take legal action if there is any misuse of the mascot and logo.

Definition of Users and User information

Users of our site are guardians, students, or anyone involved in using and running the site. Users must provide accurate information about themselves. They must enter their real name, real school, real location, and so on.  Users must also keep all the information accurate and up-to-date. 

Definition of Guardians

Guardians are educators, parents, or organizations that are committed to students global development. All guardians must be verified by other guardians who are already verified and successfully registered on Storypal. Students are required to have their accounts connected with a main guardian, identified as a “Primary Guardian” on the site. First guardian assists in safety by aiding in terminating any misconduct that occurs on the site to their set of student(s). Students can be connected with multiple guardians if needed. 

 

Definition of Premium Reviewers

Premium Reviewers are Storypal Users who comment, edit, and provide feedback on student's projects. Premium Reviewers are hand-picked by the Storypal Team. A Premium Reviewer can range from students from top universities to teachers who have been teaching both in the states and abroad. 

 

Definition of Students

Students are young learners who use Storypal to share information and their stories with others. Students are always encouraged to contact their Primary Guardian if they feel any misconduct is occurring or has occurred.

 

User Responsibilities

Storypal has taken precautions to establish credibility of users; however, there is no guarantee of identity or data other users provide is accurate. Storypal is not responsible for disputes, claims, or any sort of conflicts that occur among users. Storypal is not responsible for any damages that may occur in between users while people use our service. All content that is accessed by the user is done at the users own risk. Storypal is not responsible for what happens as a First Guardian follows the other members of the site. Users are responsible for what they say and share with others. The information you share is done so at your own risk.

 

All users are expected to adhere to the following values.

1. Security: Keep yourself safe and keep others safe. Do not give personal information to strangers. Unless you are given permission by your parent or guardian, users will not meet with other users they meet online. Users will not exchange personal emails. Student Users should inform Storypal and First Guardian if they feel that they are being harassed in anyway.

2. Respect: Put yourself in the others person's position. Users will respect all members of Storypal. They will not behave in any disrespectful manner.

3. Responsibility: All users are accountable for their actions. They are expected to use their power in a meaningful way. They are expected to take responsibility seriously like a superhero does.  

4. Community: Users are joining an international community of friends. Users will be accepting of everyone who joins the community regardless of ethnicity, gender, religion, sexual orientation, disability, or any other factor that makes a person unique.

 

All Users

All Users agree to follow the international laws of cyberspace and national laws of cyberspace set out by each user’s own country. All users are expected to provide accurate information when using the site.

 

Guardian Users

It is common of guardians to join the site with one or more student(s) whom they will be guiding through their Storypal experience. A Primary Guardian may be family members, educational instructors, community mentors or other adults who can guarantee the identity of the student and provide a safety net for the student during online activities. The Primary Guardian will have legal guardianship or a legitimately entrusted role in familial or educational contexts. By joining the site with a student, First Guardian agrees to provide evidence of legal guardianship over the student or the affiliation with the student’s legal guardians who approved and entrusted the protective role to the guardian user if requested by Storypal. If a guardian user fails to provide such evidence within a designated timeline given by Storypal, then the account may be deleted with or without a notice to the user, and associated student accounts may also be deleted. 

If you are a guardian that is affiliated with a school or any sort of educational system, you should check the school or government regulations and get permissions if needed. Storypal is not responsible of any regulatory or legal issues that may be caused by lack of permissions. Storypal abides by the COPPA rule. Students under the international age of 13 must have the consent of their legal guardian in order to use Storypal. The Primary Guardian must get consent from all the lawful parties involved in their students’ childcare if needed.

 

Student Users

 Students are asked to provide minimal information. The information Storypal users must provide: username, password, name, interests, city, country, and birthday. Storypal uses this information to facilitate networking between students users of Storypal.

When the Primary Guardians invite student users, they are confirming to Storypal that they have legal or administrative right to guide students' activities on Storypal. In particular, if a student is under the age of 13, we assume that the Primary Guardian has the legal right or has collected the approval from the legal guardians to give content Storypal to collect the child's personal information to facilitate the service. This policy is based on The Children’s Online Privacy Protection Act which does not allow online platforms from deliberately collecting personal information of students that are under the age of 13 without parent or other legal guardian.

When a student is registering for our site they are pledging that the information they are giving is true and valid. If any student users seem to have no valid guardian or has suspicious guardian connections, the account may be suspended or deleted with or without a notice. 

 

Coaching Service Users(Beta)

Student users can purchase coaching service tickets. Guardian users can purchase coaching service tickets and distribute to the student users. The tickets are called "diamond" and expire in a year. Diamonds sold in bundle can be refunded within 14 days if less than 3 diamonds are used. Users who use coaching services are agreeing to give consent to Storypal to share the user information and data with the coaching service providers. 

 

Coaching Service Providers(Beta)

When you become a coaching service provider on Storypal, you can be notified about the coaching requests made by student users, and receive a payment from Storypal for successfully provided coaching services. Guardian users can apply to be enlisted as coaching service providers. The guardian must qualify to be a subject matter expert to be eligible to become a coaching service provider on a target subject. The coaching service will be reviewed by both the service users and the Storypal Team. If the quality of the service is deemed to be inadequate, the compensation maybe withhold or withdrew.

Note that if a coaching service payment sent by Storypal to a user providing coach service is invalidated or reversed at any time for any reason, the user will be liable to Storypal for the complete amount of such payment. Situations causing this invalidation or reversal vary, but can be due to the want of a refund from the coaching service users.   

Storypal may withhold or void payments for the following reasons: (1) breach of User Terms of Service or any other policy that negatively impacts Storypal and other users, (2) there is fraudulent or suspected fraudulent activity on the suspected account, fraudulent action may include, without limitation, inaccurate reporting of exchanges (3) failure to provide proper information, (4) if the coaching service users' review of the coaching service provided is significantly low and the service provided is inadequate.

Users who provide coaching services are not employees of Storypal. Storypal is a company that is located in South Korea. Storypal will adhere to the tax laws of South Korea. It is up to each coaching service providers to properly and accurately fill out all of the tax information in their legal country of work. Stroypal is not responsible for ensuring that the users have properly submitted the tax information.  

 

Ownership

The whole of Storypals site, services, and contents are protected by copyright and have been trademarked. You agree that the Storypal site, services, intellectual property rights, and Storypal content belong to Storypal. You will not remove, alter or obscure any copyright, trademark, or other proprietary rights incorporated in to the Storypal site.

 

Licenses

You will not use Storypal Site services or content in any way. You are not granted any rights nor licenses except for the licenses and rights expressly granted in the terms of service.  

 

Modification

Storypal reserves the right to modify, discontinue or terminate the any or all Storypal services. Storypal will update the User Terms and will hold you responsible for periodically looking at the updates on all terms, policy, and other Storypal content. If you continue to use and access the site, it means that you are agreeing to all the modifications.

 

Disclaimer

STORYPAL DOES NOT WARRANT SITE OR THE SERVICES WILL MEET YOUR REQUIREMENTS,

OR THAT THE OPERATION OF THE SITE AND SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SITE AND SERVICES WILL BE CORRECTED, OR THAT ENCRYPTION ALGORITHMS, ASSOCIATED KEYS AND OTHER SECURITY MEASURES WILL BE SECURE OR EFFECTIVE. YOU ACKNOWLEDGE AND AGREE THAT STORYPAL DOES NOT OPERATE OR CONTROL THE INTERNET AND THAT (I) VIRUSES, WORMS, TROJAN HORSES, AND OTHER UNDESIRABLE DATA, OR SOFTWARE, OR (II) UNAUTHORIZED USERS (E.G., HACKERS) MAY ATTEMPT TO OBTAIN ACCESS TO AND DAMAGE YOUR DATA, WEBSITES, COMPUTERS, OR NETWORKS.

 

Legal Disputes

You and Storypal will settled any disputes by binding arbitration.  ARBITRATION NOTICE: UNLESS YOU OPT OUT OF ARBITRATION WITHIN 30 DAYS OF THE DATE YOU FIRST AGREE TO THESE PENTORS TERMS OF SERVICE, ANY TYPES OF DISPUTES DESCRIBED IN THE "LEGAL DISPUTES" SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND STORYPAL WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
 

Limitations of Liability

Under no circumstances, legal or otherwise, is Storypal or any of our affiliates responsible for any damages that may occur. The damages include the following, but are not limited to just this list, damages of use, data, profits and goodwill.

 

Indemnity

User will indemnify Storypal and its affiliates harmless from any settlements, costs, losses, and expenses of any kind from any claim or demand made by all third parties. Claims may be related to the following: use of service, violation of terms of service, violation of privacy policy, and any third person connected to a user and their submissions on the site.

 

Termination

User can terminate their account at any time. Users can delete their account. All the information the user shared on Storypal may be deleted, but any content created with others will be kept. 

Storypal reserves the right to suspend, disable or delete your Storypal account with or without cause if the account is deemed to be suspicious of negative conducts or dangerous to the community.

스토리팔은 초중 학생과 선생님, 부모님, 그 외 기타 교육 관련, 회원간 영어 글쓰기 기반 온라인 해외교류 서비스를 제공하기 위해 가입자의 개인정보를 수집합니다.

|수집하려는 개인정보의 항목|

학생 보호자 사용자(Guardian)의 경우 성, 이름, 성별, 국가, 도시, 소속 기관 명, 핸드폰 번호, 이메일에 대한 정보를 수집합니다. 학생 사용자(Student)의 경우 성, 이름, 국가, 도시, 소속기관, 생년월일, 관심사, 보호자 유저네임을 통한 연락정보를 수집합니다. 

|개인정보의 보유 및 이용 기간|

가입자의 개인정보는 가입자가 계정을 삭제할 경우 함께 삭제됩니다. 단, 법률상의 문제 혹은 타 회원의 신고가 있을 경우 타 회원의 안전과 법적인 조치를 위해 문제가 확인 될 때까지 정보를 보유합니다.
